The recommendation to the Superintendent is that the facility use agreement or lease agreement as developed by the Cultural Arts Committee in conjunction with the Board of Education attorney be approved as presented. 

Section 6 of the Intergovernmental Agreement between Barrow County and the Barrow County School System titled, Facility Operation / Management, calls for a facility use document or lease agreement to be established to allow for third part leasing of the facility.

 

Amendment to Intergovernmental Agreement (IGA) for Operation of Cultural Arts Center   

The following proposed changes to this agreement are recommended:

Section 4              Use of Facility

• Barrow County has signed a contract with a consultant, Golden Productions, Inc. to manage events on many of their dedicated usage days. A recommendation is made to amend section 4 of the IGA to exempt Barrow County Schools from providing staff members for events managed by said consultant.
• A recommendation is made to amend section 4 of the IGA to remove the provision which states, “Reservations for use of the Facility shall be made by contacting the Principal of the Barrow County School System College and Career Academy . . . “ but include language wherein this individual or his / her designee must still be consulted prior to any reservations to insure the normal operation of the school is not negatively impacted by events at the amphitheater.
• The recommendation is made to extend Barrow County’s hours of use of the premises on dedicated usage days from the current timeframe listed in the Agreement of 7:00am to 10:00pm to 7:00am to 11:00pm in order to align with the County noise ordinance.

 

Section 6              Facility Operation / Management

• This section begins, “Upon completion of the Facility, the School System shall be responsible for selecting an individual or entity to operate and manage the Facility on behalf of the School System and Barrow County (the “Operator”), and the School System shall be responsible for paying any compensation associated with such operational services. ”The recommendation is made to allow for Barrow County and the Barrow County School System to each select an entity to operate and manage the Facility on their agreed upon and established separate dates of use and that Barrow County and the Barrow County School System are each responsible for compensating their individual facility management entities accordingly.

 

Section 7              Insurance and Signage

The Agreement currently calls for the Facility to include the language, “cultural arts center” in its name.  The recommendation is made to remove this requirement.
