Recommendation
The Superintendent recommends the proposed revision by the County, of the Third Amendment to the Intergovernmental Agreement with the Board of Education and the Board of Commissioners; Section I, Article 7.3.

Summary

The Board of Education approved a Third Amendment to its Intergovernmental Agreement with the Board of Commissioners on June 6, 2017.

The County has since reviewed the document and has asked to revise the last sentence of Section 1. by essentially adding the words, “and agreement by.”

Section 1 of the Third Amendment currently reads in full as follows,

The Parties agree to amend Article 7.3 of the original Agreement to delete any requirement that the name of the Facility shall include the language “cultural arts center,” and instead hereby agree that the Facility shall be named the “Innovation Amphitheater.”  The Parties further acknowledge that this provision does not foreclose the possibility that the School System may determine, after consultation with the County, to rename the Facility in the best interest of the citizens of the County.

The proposed revision to Section 1 of the Third Amendment as recommended by the County would read as follows, The Parties agree to amend Article 7.3 of the original Agreement to delete any requirement that the name of the Facility shall include the language “cultural arts center,” and instead hereby agree that the Facility shall be named the “Innovation Amphitheater.”  The Parties further acknowledge that the School System may determine, after consultation with and agreement by the County, to rename the Facility in the best interest of the citizens of the County.
