This Privacy Statement describes eBOARDsolutions, Inc''''s (EBS) practices regarding the collection, use and disclosure of the information we collect from and about you when you use our corporate Web site (http://www.eboardsolutions.com) and our web-based application Simbli. In this Privacy Statement, we refer to our Web site as our "Web site" and to our web-based application as the "Application". By accessing our Web site or Application, you agree to the collection and use of information in accordance with this Privacy Statement and our Terms of Service. A link to this Privacy Statement can be found on the Web site and within our Application.

EBS is strongly committed to protecting the privacy of its online guests and subscribing customers. We don''''t collect personally identifiable information about individuals - such as their names and postal and/or email addresses - except when it is knowingly provided by such individuals. We believe that maintaining privacy on the Web is very important and hope you will read this Privacy Statement carefully so that you will clearly understand both our commitment to you and your privacy and our methods of collecting and using information. 

We consider the following to be examples of personally identifiable information but there maybe others: your first and last name, email address, home address or ZIP Code, phone number, date of birth, gender, username and password, and certain other information, such as a Social Security number, if it is linked with your personally identifiable information. We strongly recommend that you not use your Social Security number or any other important ID as a user ID or password for our Application.

What information do we collect?

Information You Give Us

On our Web site:
You may use our Web site without registering or submitting any personally identifiable information. However, several features of the Web site require entry of personally identifiable information. This information is requested so that we can act and respond to you. You can choose not to provide certain information, but then you will not be able to take advantage of these features. 

For example when you request a demonstration of our Application we require you to provide your personal contact information, such as your name, company, phone number, and email address. In addition, if you send us a message or use an online form, application, or service offered through EBS’s Web site, we may receive and may need to retain that personally identifiable information in order to act or respond to you. The information will be treated confidentially within our company, as we protect other confidential information.

In our Application:
EBS provides our Application to subscribing customers ("Subscribers") to facilitate management of their organizations. The Application is not part of our corporate Web site. The Application enables our Subscribers to request information from you when you access certain content within the Application. You may also be required to supply personally identifiable information to establish a user account within the Subscriber''''s Application. 

EBS serves as a Data Processor for the Subscribers and as such EBS does not own the information that is submitted to our Application, except as described below. Use of the Application is subject to the Terms of Service which include Permitted and Prohibited Use. Personally identifiable information submitted to our Application is subject to the privacy practices and policies of the relevant Subscriber, who owns the data. 

As an authenticated (logged in) user, you may access the Application online help system. In order to submit a request for assistance, we require you to supply certain information such as your first and last name and email address. We request that personally identifiable information in order to act or respond to you. The information will be treated confidentially within our company, as we protect other confidential information.

How long we retain your Personal Data depends on the type of data and the purpose for which we process the data. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required and permitted by law.

Information Collected Automatically

Cookies
Our  Web site and Application automatically collect some non-personally identifiable information about you when you request pages through your browser. We place cookies on web site visitors'''' computers to collect aggregate information for site traffic analysis, such as the number of visitors and the number of pages viewed. (Cookies are small files sent to your browser from a web site.) 

The aggregate information we collect through cookies helps EBS monitor how you and other visitors use the site, allowing us to provide an optimal experience and better service; this information is never used to identify you personally. However, EBS’s Web site has been designed to provide nearly full functionality without the use of cookies. You can set your web browser to reject cookies without affecting the functionality of our Web site or our Application.

Log Files
When you use our Application, our servers automatically record certain information in server logs. These server logs may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of the Application that you visit, the time and date of your visit, the time spent on those pages and other statistics. Log files help us monitor, analyze, improve and maintain the Application and diagnose and fix any Application-related issues.


How We Share Your information

Except as specifically stated in this Privacy Statement, we do not share personally identifiable information collected through our Web site or Application with third parties, but we may share this personally identifiable information with affiliates of EBS, and other trusted companies and organizations who perform work for us under contract or sell products or services that complement our products and services.  

We also may disclose personally identifiable information (a) in response to a subpoena, court order or legal process, to the extent permitted and required by law; (b) to protect user security or the security of other persons, consistent with applicable laws; or (c) in order to enforce the Terms of Service that apply to our Application. We exercise commercially reasonable care otherwise not to share, disclose or sell the personally identifiable information of users to third-parties, except with the prior approval of the user. 

EBS may engage reputable third party services to collect and analyze aggregate anonymous visitor information like IP addresses, browser types (such as Internet Explorer), referring pages, pages visited and time spent on a particular service or feature. EBS collects this information for statistical analysis of web page traffic patterns; to administer our service and servers; to allow for auditing of our services by some third parties who have that right; and for internal purposes to make marketing decisions and improving our Web site and Application.

Email Communications

On occasion, EBS may send emails to individuals such as registrants and users who have provided us with their email address, informing them of Application-related news or EBS events or promotions we think might be of interest to them.  EBS may use third party email services to provide such communications. When you give us your contact information, we will share your name and email address as necessary for the third party to provide service. These third parties are not permitted to use such information for their own purposes.

Email recipients may always opt out such emails by following the unsubscribe instructions included in the email message.

Do Not Track

Some browsers offer a "do not track" option that lets you tell web sites that you don''''t want to have your online activities tracked. EBS does not currently respond to "do not track" signals.

Links to Other Web Sites

Links from the EBS Web site and Application can take you to services and activities sponsored by EBS as well as to third party websites or resources. 

The information practices of third party websites are not covered by this Privacy Statement or any other EBS policies or terms of service. Please remember that when you use a link to go from our Web site or Application to another website,  your activities on that third party website are subject to such third party website''''s own rules and policies.  Be sure that you know the terms of use and privacy policy of any linked website before using it.

Social Media Features

The Web site and Application may use social media features, such as the Facebook ‘like’ button (“Social Media Features”). These features may collect your IP address and which page you are visiting on the Web site, and may set a cookie to enable the feature to function properly. You may be given the option by such Social Media Features to post information about your activities on the Web site to a profile page of yours that is provided by a third party Social Media network in order to share with other within your network. 

Social Media Features are hosted by a third party and your interactions with these features are governed by the privacy policy of the company providing the relevant Social Media Features.

Children Under Thirteen Years of Age

We do not knowingly collect personally identifiable information from or about children under thirteen years of age.

Security

No data transmissions over the Internet can be guaranteed to be 100% secure.  Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information you transfer to EBS is done at your own risk. 
 
Once we receive your transmission, we make reasonable efforts to ensure security on our systems.  We use firewalls and other means to protect your information from unauthorized access, disclosure, alteration, or destruction.  

In Our Application:
EBS uses commercially reasonable and industry-standard physical, managerial, and technical safeguards to preserve the integrity and security of your information. For example, we continuously and regularly back up your data to help prevent data loss and aid in data recovery. We also guard against common web attack vectors and implement firewalls and access restrictions on our servers to secure our network and protect your information. 

If we learn of an Application security breach, we may attempt to notify you electronically so that you can take appropriate protective steps.  By using the Application or providing personally identifiable information to us you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Application.  We may post a notice in our Application if a security breach occurs.  We may also send an email to you at the email address you have provided to us in these circumstances.  Depending on where you live, you may have a legal right to receive notice of a security breach in writing.
