A. Yes. Under the Teacher Tenure Act, the board approved the superintendent’s intention (not recommendation) to transfer before the teacher was notified. Then the teacher had the right to challenge that intention and the board voted on the recommendation after a hearing. Under the Students First Act, the “intention” notification is eliminated. The superintendent issues notice of her recommendation, the teacher has the right to meet with the board and then the board votes.
Q. Can the teacher voluntarily transfer?
A. If you can get a teacher to agree to transfer in writing, that should be done and can be done at any time.
